The Tamale High Court has ordered a rerun of the Kpandai parliamentary election. The court says a fresh poll must be held within 30 days.
The ruling was delivered by Justice Emmanuel Brew Plange after a legal challenge to the 2024 parliamentary results in the Kpandai constituency. The petition claimed that serious irregularities in the voting and collation processes affected the credibility of the election.
The case was filed by Daniel Nsala Wakpal, former Member of Parliament and the NDC parliamentary candidate for Kpandai. He challenged the election of Matthew Nyindam as MP.
Wakpal argued that the December 7, 2024 election was invalid. He pointed to irregularities and inconsistencies on FORM 8A (the Pink Sheet) for 41 out of the 152 polling stations in the constituency.
According to him, the election was not conducted in line with Regulation 39 of the Public Elections Regulations, 2020 (C.I. 127), and the non-compliance affected the final results.
He further argued that the declaration and publication of the results did not follow Regulation 43 of C.I. 127, and this also affected the integrity of the entire outcome.
Wakpal therefore asked the court to set aside the results from the 41 affected polling stations. He requested an order directing the Electoral Commission to conduct a rerun in those polling stations on a date chosen by the court.
In his final judgment, Justice Plange agreed with Wakpal’s petition. He ordered the Electoral Commission to organise a new election to determine the rightful winner of the Kpandai parliamentary seat.
